Terms of Service

Last updated: 1 October 2026

Overview

Welcome to Nae Scotland, Nae Party.

The words “we,” “us” and “our” refer to Nae Scotland, Nae Party. We operate this website and online store, including the information, content, features, tools, products and services available through it, collectively referred to as the “Services.”

Our store is powered by Shopify, which provides the e-commerce platform that allows us to offer our products and Services to you.

These Terms of Service explain your rights and responsibilities when using our website or purchasing from us. They also contain important information about orders, payments, shipping, intellectual property, warranties and liability.

By visiting, interacting with or using our Services, you agree to these Terms of Service and our Privacy Policy.

If you do not agree with these Terms or our Privacy Policy, please do not use the Services. Nae hard feelings — we’d rather keep everything clear from the start.

1. Access and Accounts

By using the Services, you confirm that you are at least the age of majority in the country, state, province or jurisdiction where you live.

Where permitted by law, you may allow a minor under your care to use the Services through a device that you own, purchase or manage.

When browsing our store, creating an account or placing an order, you may be asked to provide information such as your:

  • Name.
  • Email address.
  • Billing information.
  • Payment information.
  • Shipping address.
  • Delivery contact details.

You agree that the information you provide will be accurate, current and complete.

You are responsible for:

  • Keeping your account details and password secure.
  • All activity carried out through your account.
  • Informing us promptly if you believe your account has been accessed without permission.

You may not sell, transfer, assign or license your account to another person.

2. Our Products

We make every reasonable effort to display and describe our products accurately.

However, colours, proportions and other visual details may appear differently depending on your:

  • Device.
  • Screen.
  • Browser.
  • Display settings.
  • Lighting conditions.

There may also be slight variations between the product displayed online and the finished item, particularly where products are printed, manufactured or prepared individually.

Such minor variations are not normally considered defects.

Product descriptions, designs, prices and availability may change without notice. We may also:

  • Discontinue a product.
  • Limit the quantity available.
  • Restrict sales to particular people, regions or jurisdictions.
  • Refuse an order where reasonably necessary.

We promise to show our products in their best light — but unfortunately, we cannot personally calibrate every screen between Aberdeen and Albuquerque.

3. Made-to-Order and Personalised Products

Many products sold by Nae Scotland, Nae Party are printed or produced specifically after an order is placed.

Where a product includes customer-selected or customer-supplied information, you are responsible for checking all details before submitting your order, including:

  • Names.
  • Dates.
  • Wording.
  • Spelling.
  • Images.
  • Sizes.
  • Colours.
  • Design selections.
  • Delivery information.

We may reproduce customer-supplied information exactly as it is submitted.

Once an order has entered production, changes or cancellations may no longer be possible.

Personalised or made-to-order products may also be subject to different return or cancellation conditions, as explained in our Refund Policy and as permitted by applicable law.

Nothing in this section affects any rights you may have where a product arrives damaged, defective, incorrect or otherwise qualifies for a remedy under our Refund Policy or applicable law.

We are not responsible for mistakes contained in information or artwork approved or submitted by the customer.

Please give everything one final check before ordering. A missing letter can turn a heartfelt gift into something your family discusses for years.

4. Orders

When you submit an order, you are making an offer to purchase the selected products.

Your order is not accepted until:

  • Payment has been authorised or received.
  • We send confirmation that the order has been accepted or entered into production.

We reserve the right to accept, reject, limit or cancel an order where reasonably necessary, including where:

  • A product is unavailable.
  • Pricing or product information is incorrect.
  • We suspect fraud or unauthorised activity.
  • Delivery is unavailable to the selected destination.
  • The order breaches these Terms.
  • A technical or payment-processing issue occurs.

If we reject or cancel an order after payment has been taken, we will refund the affected amount using the original payment method where reasonably possible.

Please review your order carefully before submitting it. We may be unable to change or cancel an order after it has been accepted or entered production.

Purchases are also subject to our Refund Policy.

Products purchased from our store are intended for personal or household use unless we have agreed otherwise in writing.

You may not purchase products for unauthorised commercial resale, copying or reproduction.

5. Prices, Payments and Billing

Prices, promotions and discounts may change without notice.

The price charged will normally be the price displayed when you place your order and will be shown in your order confirmation.

Unless stated otherwise, displayed prices may not include:

  • Delivery charges.
  • Applicable taxes.
  • Duties.
  • Customs charges.
  • Import fees.
  • Other charges that may apply to your destination.

Any additional charges that apply will be displayed during checkout where possible or may be collected by the appropriate carrier, customs authority or government agency.

Promotional offers may be governed by separate terms. Where promotional terms conflict with these Terms, the specific promotional terms will apply to that offer.

You agree to provide accurate and complete payment, billing and account information.

You also confirm that:

  • You are authorised to use the chosen payment method.
  • The payment information provided is correct.
  • Charges associated with your purchase will be honoured.
  • You will pay the total amount shown at checkout, including applicable taxes and delivery charges.

We may correct obvious pricing errors.

If a significant pricing error affects your order, we may contact you and offer the choice of:

  • Paying the correct price.
  • Cancelling the affected item or order for a refund.

6. Discount Codes and Promotions

Discount codes and promotional offers:

  • Must be used within the stated promotional period.
  • May be limited to selected products or customers.
  • May require a minimum purchase.
  • May not be combined unless expressly stated.
  • Cannot normally be exchanged for cash.
  • May be withdrawn or amended where permitted by law.

Only one discount code may be used per order unless the promotion specifically allows otherwise.

We may cancel or refuse a promotion where we reasonably believe it has been:

  • Used fraudulently.
  • Shared contrary to its terms.
  • Applied because of a technical error.
  • Used in a way that was clearly not intended.

7. Shipping and Delivery

Nae Scotland, Nae Party ships to the countries and regions currently made available through our online checkout.

Available delivery destinations may change from time to time as we expand our Services. If a destination is available for selection during checkout, we currently offer delivery to that destination.

Delivery dates and times are estimates unless we expressly confirm otherwise.

Delivery may be affected by circumstances outside our reasonable control, including:

  • Carrier delays.
  • Customs processing.
  • Weather.
  • Public holidays.
  • Industrial action.
  • Incorrect delivery information.
  • Events affecting transport, production or supply chains.

We are not responsible for delays caused by circumstances outside our reasonable control, but we will do our best to assist where an order appears to be delayed or lost.

You are responsible for providing a complete and accurate delivery address.

We are not responsible for failed or delayed delivery caused by incorrect or incomplete information supplied by you.

Additional delivery charges may apply if an order must be:

  • Redirected.
  • Re-delivered.
  • Reproduced.
  • Returned and shipped again.

Risk of loss or damage will pass to you when the order is delivered to you or a person you have authorised to receive it, except where applicable law provides otherwise.

8. International Orders, Customs and Duties

Where we offer delivery outside the country from which an order is fulfilled, the shipment may be subject to customs checks, taxes, import duties or other charges imposed by the destination country.

Unless stated otherwise during checkout, these charges are the responsibility of the customer and are not included in the product or delivery price.

We do not control customs authorities and cannot guarantee how quickly an international shipment will be cleared.

You are responsible for confirming that the products ordered may legally be imported into your destination country.

Any available delivery destination and applicable delivery charge will be shown during checkout.

9. Returns, Refunds and Exchanges

Returns, refunds and exchanges are handled according to our Refund Policy.

Refund requests may be considered where, for example:

  • You received the wrong item.
  • The item arrived damaged.
  • The item is defective.
  • Your request otherwise qualifies under our Refund Policy.

Refund requests must be submitted within the period stated in our Refund Policy.

We may request:

  • Your order number.
  • A description of the issue.
  • Photographs of the product and packaging.
  • Other information reasonably required to assess the request.

Please do not send products to our mailing address unless our customer service team specifically instructs you to do so.

Nothing in these Terms limits any mandatory consumer rights available to you under applicable law.

10. Intellectual Property

All content made available through the Services may be protected by copyright, trademark and other intellectual-property laws.

This includes, without limitation:

  • Brand names.
  • Logos.
  • Designs.
  • Illustrations.
  • Product artwork.
  • Photographs.
  • Graphics.
  • Videos.
  • Written content.
  • Website layouts.
  • Slogans.
  • Product names.

Unless expressly stated otherwise, this content is owned by or licensed to Nae Scotland, Nae Party.

You may use the Services for personal and non-commercial purposes only.

Without our prior written permission, you must not:

  • Copy or reproduce our designs.
  • Download product artwork for commercial use.
  • Modify or create derivative works from our content.
  • Manufacture products using our artwork.
  • Republish or redistribute our content.
  • Sell or license our images or designs.
  • Remove copyright, trademark or ownership notices.
  • Use our branding in a way that suggests an unauthorised partnership or endorsement.

Purchasing a product does not transfer ownership of the artwork, design, copyright or other intellectual property used on that product.

You are buying the product — not adopting the artwork and taking it home as your own wee copyright.

All rights not expressly granted are reserved.

11. Customer-Submitted Content

Where you upload or provide text, photographs, artwork, logos or other materials, you confirm that:

  • You own the material or have permission to use it.
  • We may use it to provide the relevant Service or fulfil your order.
  • It does not infringe another person’s rights.
  • It is not unlawful, defamatory, abusive or misleading.
  • It does not contain malicious software or harmful code.

You remain responsible for customer-submitted material.

We may refuse to print, produce or publish material that we reasonably consider:

  • Illegal.
  • Hateful.
  • Abusive.
  • Defamatory.
  • Obscene.
  • Infringing.
  • Misleading.
  • Harmful to another person.
  • Contrary to our brand values or policies.

Our use of customer-submitted content will normally be limited to providing the relevant Service, processing, manufacturing, fulfilling and supporting an order unless you separately give us permission to use it for another purpose.

12. Reviews, Feedback and Suggestions

You may submit reviews, ideas, suggestions, photographs or other feedback.

By submitting public feedback or content, you grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, edit, publish and display it for purposes including:

  • Operating our website.
  • Promoting our products.
  • Improving our Services.
  • Sharing customer reviews.
  • Marketing our brand.

This licence does not transfer ownership of your original content to us.

You confirm that:

  • You have the right to submit the content.
  • The content is honest and accurate.
  • Any reward, discount or incentive connected with the review has been disclosed where required.
  • The content does not violate another person’s rights.
  • The content complies with applicable law.

We may moderate, edit or remove content that we reasonably believe violates these Terms or applicable law.

We are not required to:

  • Keep feedback confidential.
  • Pay for unsolicited ideas.
  • Publish every review.
  • Respond to every submission.

13. Optional Third-Party Tools

We may provide access to features or tools operated by third parties.

We do not necessarily control, monitor or endorse those tools.

Third-party tools are provided on an “as available” basis and may be governed by separate terms and privacy policies.

Your use of third-party tools is at your own discretion and risk.

Please review the relevant provider’s terms before using them.

New tools, resources and features added to the Services will also be subject to these Terms unless stated otherwise.

14. Third-Party Links

The Services may contain links to websites or services operated by third parties.

We do not control or guarantee their:

  • Content.
  • Accuracy.
  • Security.
  • Availability.
  • Products.
  • Services.
  • Privacy practices.

You access third-party services at your own discretion.

Any complaint concerning a third-party product or service should normally be directed to the relevant provider.

The inclusion of a link does not necessarily mean that we endorse the third party.

15. Relationship With Shopify

Our store is powered by Shopify, but purchases made through our store are made directly between you and Nae Scotland, Nae Party.

Shopify provides the platform and certain supporting services but is not the seller of our products.

To the fullest extent permitted by law, Shopify is not responsible for:

  • Our products.
  • Order fulfilment.
  • Customer service.
  • Refund decisions.
  • Loss or damage arising from products purchased from us.

Nothing in this section limits rights or responsibilities that cannot legally be excluded.

16. Privacy

Personal information collected through the Services is handled according to our Privacy Policy.

Because Shopify hosts our store, Shopify may also collect and process information about your access to and use of the Services.

Information may be shared with Shopify and other service providers, including providers located outside the country where you live, where necessary to operate and improve the Services.

Please review our Privacy Policy and Shopify’s applicable privacy information for further details.

17. Errors, Inaccuracies and Omissions

Occasionally, the Services may contain errors, inaccuracies or omissions relating to matters such as:

  • Product descriptions.
  • Pricing.
  • Promotions.
  • Availability.
  • Shipping costs.
  • Delivery estimates.
  • Product images.

We may correct errors, update information or cancel affected orders where reasonably necessary.

Where an error materially affects an accepted and paid order, we will contact you where practicable and provide an appropriate remedy, such as:

  • Confirming the corrected information.
  • Offering an alternative.
  • Cancelling the affected product and issuing a refund.

We reserve the right to correct a typo. Even the finest Scottish eyesight can miss one now and again.

18. Prohibited Uses

You may use the Services only for lawful purposes.

You must not use the Services to:

  • Break any applicable law.
  • Infringe intellectual-property rights.
  • Harass, threaten, abuse or harm another person.
  • Submit false or misleading information.
  • Impersonate another person or organisation.
  • Upload viruses or malicious code.
  • Send spam or unauthorised promotions.
  • Collect personal information about others without permission.
  • Scrape, crawl or copy the Services through automated methods without authorisation.
  • Circumvent security features.
  • Interfere with the proper operation of the website.
  • Reproduce, resell or commercially exploit any part of the Services without permission.
  • Use our products, content or designs for unlawful, hateful or harmful purposes.

We may suspend or terminate access where we reasonably believe these Terms have been breached.

19. Suspension and Termination

You may stop using the Services at any time.

We may suspend, restrict or terminate your access where reasonably necessary, including where:

  • You breach these Terms.
  • We suspect fraudulent or unlawful activity.
  • Your actions threaten the security of the Services.
  • Continuing to provide access would expose us or another person to legal or financial risk.

Termination does not affect rights or obligations that arose before termination.

Sections that are intended to continue after termination — including intellectual property, liability, indemnification, governing law and dispute provisions — will remain in effect.

20. Disclaimer of Warranties

We aim to provide accurate, reliable and useful Services.

However, except where expressly stated or required by law, the Services are provided on an “as is” and “as available” basis.

We do not guarantee that:

  • The website will always be available.
  • Access will be uninterrupted.
  • The Services will be completely error-free.
  • Every product will remain available.
  • All information will always be current.
  • The website will be free from every possible security threat.

Nothing in these Terms excludes any warranty, guarantee or consumer right that cannot legally be excluded.

21. Limitation of Liability

To the fullest extent permitted by applicable law, Nae Scotland, Nae Party and our employees, partners, affiliates, contractors, service providers and licensors will not be liable for indirect, incidental, special, punitive or consequential losses arising from your use of the Services or products purchased through them.

This may include losses relating to:

  • Lost profits.
  • Lost revenue.
  • Lost savings.
  • Lost data.
  • Business interruption.
  • Replacement costs.

Our total liability relating to a particular order will not normally exceed the amount you paid for that order, except where applicable law requires otherwise.

Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for:

  • Fraud or fraudulent misrepresentation.
  • Death or personal injury caused by negligence where it cannot be excluded.
  • Deliberate wrongdoing.
  • Mandatory consumer rights.

22. Indemnification

To the extent permitted by law, you agree to compensate and protect Nae Scotland, Nae Party, Shopify and our respective affiliates, partners, employees, agents, contractors, licensors and service providers against third-party claims arising from:

  • Your material breach of these Terms.
  • Your unlawful use of the Services.
  • Your infringement of another person’s rights.
  • Content or materials submitted by you.

This obligation will apply only to the extent that the claim was caused by your actions or breach.

We will notify you of a relevant claim and provide reasonable information about it.

23. Severability

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law.

Any unenforceable portion will be treated as removed without affecting the validity of the remaining Terms.

24. Waiver and Entire Agreement

If we do not immediately enforce a right under these Terms, that does not mean that we have waived that right.

These Terms, together with the policies referred to within them, form the entire agreement between you and us regarding use of the Services.

They replace previous communications or agreements concerning the same subject matter.

25. Assignment

You may not transfer or assign your rights or obligations under these Terms without our prior written consent.

We may transfer or assign our rights and obligations as part of:

  • A business sale.
  • A merger.
  • A restructuring.
  • A transfer to an affiliate.
  • Another legitimate business transaction.

Any transfer will remain subject to applicable law.

26. Governing Law

These Terms and any separate agreement through which we provide Services will be governed by the laws of Singapore, without limiting any mandatory consumer protections that apply in the country or jurisdiction where you live.

The courts of Singapore will have jurisdiction over disputes, except where applicable consumer law gives you the right to bring proceedings elsewhere.

Before beginning formal legal proceedings, you and Nae Scotland, Nae Party agree to make a reasonable effort to resolve the matter directly and in good faith.

27. Changes to These Terms

We may update these Terms to reflect changes to:

  • Our Services.
  • Our business practices.
  • Shopify’s platform.
  • Available countries or delivery regions.
  • Applicable laws or regulations.
  • Operational or security requirements.

The latest version will be posted on this page with an updated revision date.

Where required by law, we will provide additional notice of material changes.

Your continued use of the Services after updated Terms take effect means that you accept the revised Terms, to the extent permitted by applicable law.
